Cots recalled over serious safety concerns – media release

Serious safety concerns have led to a voluntary nationwide recall of three styles of wooden cot sold online by supplier Emall Pty Ltd.

The Australian Competition and Consumer Commission today published the recall notice, which applies to the Wooden Baby Cot Crib, Toddler Bed & Wooden Baby Cot Crib and Toddler Cradle Bed, which were primarily being sold through the online shopping site eBay.

Vasilios Koutropoulos, trading as ‘Olympia Express Tourist and Travel Office’, aka ‘Olympia Express Travel Services’ – public warning

The Acting Commissioner for Consumer Affairs is issuing a public warning notice to warn consumers about the conduct of the trader by the name of Vasilios Koutropoulos, trading as ‘Olympia Express Tourist and Travel Office’, also known as ‘Olympia Express Travel Services’.

Consumer and Business Services (CBS) have received a number of complaints from consumers within SA who have had dealings with Vasilios Koutropoulos, trading as ‘Olympia Express Tourist and Travel Office’, also known as ‘Olympia Express Travel Services’.

It is alleged that Vasilios Koutropoulos, trading as ‘Olympia Express Tourist and Travel Office’, also known as ‘Olympia Express Travel Services’ has, on a number of occasions:

  1. accepted payment for services and has failed to supply all the services within a reasonable time frame in breach of section 158(7) of the Australian Consumer Law (SA).

The Acting Commissioner is warning the public about the alleged conduct as the Acting Commissioner:

  1.  has reasonable grounds to suspect that the conduct may constitute contraventions of the Australian Consumer Law (SA);
  2. is satisfied that one or more persons have suffered, or is likely to suffer detriment as a result of the alleged conduct; and
  3. is satisfied that it is in the public interest to issue a public warning notice.

Andrew James Laundy trading as ‘Creative Renovations & Demolitions’ and ‘AJ’s contracting’ – public warning

The Acting Commissioner for Consumer Affairs is issuing a public warning notice to warn consumers not to deal with a trader by the name of Andrew James Laundy trading as ‘Creative Renovations & Demolitions ‘ and ‘Aj’s Contracting’.

Consumer and Business Services (CBS) have received a number of complaints from consumers within SA who have had dealings with Andrew Laundy.

It is alleged that Andrew Laundy has been contracting with consumers through an online website where consumers can seek quotes from tradespeople . Andrew Laundy has contracted with various consumers to perform building work in the nature of paving, painting, ceiling repairs, fencing, and shed renovations. He has allegedly taken deposits and failed to commence or complete the work . The Acting Commissioner has reasonable cause to suspect that Andrew Laundy:

  1. has accepted payment for services and has failed to supply all the services within a reasonable time in breach of section 158(7) of the Australian Consumer Law (SA).
  2. is carrying on a business in South Australia whilst not being licensed under the Building Work Contractors Act 1995 (SA)

The Acting Commissioner is warning the public about the alleged conduct as the Acting Commissioner:

  1. has reasonable grounds to suspect that the conduct may constitute contraventions of the Australian Consumer Law (SA) and the Building Work Contractors Act 1995 (SA);
  2. is satisfied that one or more persons have suffered, or is likely to suffer detriment as a result of the alleged conduct; and
  3. is satisfied that it is in the public interest to issue a public warning notice.

Hildenbrand Roads Pty Ltd – public warning

The Commissioner for Consumer Affairs is issuing a public warning notice to warn consumers not to deal with a business by the name of Hildenbrand Roads Pty Ltd who offer “Bitumen sealing and hot mix asphalt” services in South Australia.

It is alleged Hildenbrand Roads Pty Ltd:

  1. is carrying on business as a building work contractor in South Australia whilst not being licensed under the Building Work Contractor s Act 1995 (“BWC Act”);
  2. has made unsolicited approaches to consumers and businesses claiming to have bitumen left over from previous jobs and seeking to engage such persons to enter into contracts for laying bitumen; and
  3. has carried out such work to an unsatisfactory standard.

The Commissioner is warning the public about the alleged conduct as the Commissioner :

  1. has reasonable grounds to suspect that Hildenbrand Roads Pty Ltd has supplied services in an unsatisfactory manner;
  2. is satisfied that one or more persons have suffered, or is likely to suffer detriment as a result of the alleged conduct; and
  3. is satisfied that it is in the public interest to issue a p!Jblic warning notice.

Addendum to public warning – Green Engineering (Vic) Pty Ltd

On 30 March 2017 the Commissioner for Consumer Affairs issued the following statement:

Since the Public Warning Notice issued on 24 July 2015 in respect of Green Engineering (Vic) Pty Ltd, Green Engineering has undertaken a number of positive steps to address the conduct of concern giving rise to the Public Warning Notice. In particular, Green Engineering (Vic) Pty Ltd:

1. is now licensed to contract for any electrical work in accordance with the Plumbers, Gasfitters and Electricians Act 1995 (SA)

2. has attended CBS with a willingness to cooperate and resolve consumer disputes

3. has resolved outstanding consumer disputes

and

4. has accepted responsibility for its actions by pleading guilty, on 12 July 2016, to breaches of the Australian Consumer Law (ACL), the Fair Trading Act 1987 and the Plumbers, Gas Fitters and Electricians Act 1995.

Itinerant Builders Operating in NE Suburbs of SA – public warning

The Commissioner for Consumer Affairs is issuing a public warning statement to warn consumers not to deal with itinerant builders reportedly operating in the metropolitan area and particularly the North Eastern suburbs.

The Commissioner has identified these itinerant builders as James Doran, Patrick Doran, Michael Doran and James Doran Junior. These persons are also using the trading name Kennedy Roofing and Paving. The Commissioner has obtained reports of these persons using other alternative names such as “Patrick”, “Mike” and “George”.

Consumers have been approached by two men offering to perform roofing work including roof restoration work. Flyers for Kennedy Roofing and Paving have been distributed. In one instance, a consumer agreed to pay cash for roofing.

The Commissioner is warning the public about the alleged conduct as the Commissioner has reasonable grounds to suspect the Kennedy Roofing and Paving and the named individuals are breaching the Building Work Contractors Act 1995 (SA) in that they are carrying on business as a builder without a licence and advertising or holding themselves out as being entitled to carry on the business of a building work contractor.

M & M Greenworks Tree Services – public warning

The Commissioner for Consumer Affairs is issuing a public warning statement to warn consumers not to deal with a business by the name of M&M Greenworks Tree Services and individuals associated with the business by the names of “Fui” and “Hay”.

Residents in the Adelaide Hills area have been door-knocked by these men offering tree lopping services . In particular , the individuals sought to have an elderly lady accompany one of the men to the bank to withdraw cash to pay for the services before the work was carried out and a price was agreed upon. The men have been described as driving a White Toyota Landcruiser utility, Victorian Registration YYU-356 and White lsuzu truck, Victorian Registration WXL-218.

The Commissioner is warning the public about the alleged conduct as the Commissioner:

  1. has reasonable grounds to suspect that it may constitute breaches of the Australian Consumer Law;
  2. is satisfied that one of more persons have suffered, or is likely to suffer detriment as a result of the alleged conduct; and
  3. is satisfied that it is in the public interest to issue a public warning notice.

Whyblue Pty Ltd trading as City Southside Real Estate – public warning

The Commissioner for Consumer Affairs is issuing a public warning statement to warn consumers not to deal with Whyblue Pty Ltd trading as City Southside Real Estate and sole director Shaun Modra.

City Southside Real Estate and Shaun Modra are both currently unlicensed as land agents in South Australia. The Commissioner has reasonable grounds to suspect that Shaun Modra, as Director of City Southside Real Estate, has been collecting rental payments and not passing those monies on to the entitled parties.

As a result, the Commissioner has today appointed an Administrator pursuant to s 16 of the Land Agents Act 1994 to administer the trust account of City Southside Real Estate. A temporary manager has also been appointed to transact any urgent or uncompleted business.

The Commissioner is satisfied that it is in the public interest to warn consumers not to deal with City Southside Real Estate or Shaun Modra as there is a risk that consumers may suffer detriment and may not be afforded the protections provided by the Land Agents Act 1994 (SA).
