The Government of South Australia has initiated a review of the building and construction industry by Consumer and Business Services (CBS).
The review is in recognition of the vital role the industry plays in driving growth, providing homes and important infrastructure. It will strive to modernise the laws governing builders and tradespeople to:
- enhance industry compliance
- protect and inform consumers
- make dispute resolution easier
- support the building sector to deliver high-quality building work.
Background
A range of reform items have been put forward by industry stakeholders during roundtable discussions, identified by the Minister for Consumer and Business Affairs and Government agencies, and recommended by the national report Building Confidence: Improving the effectiveness of compliance and enforcement systems for the building and construction industry across Australia (external site).
Proposals in consultation
Reforms proposed by the government include:
- new registration requirements and increased oversight for building inspectors, owner builders and developers
- improvements to dispute resolution processes for consumers and building industry workers
- continuous professional development for building industry workers
- new enforcement tools and increased penalties to address poor practices within industry
- changes to building work contract requirements, including new rules for the use of sunset clauses in off-the-plan sales.
