South Australians were invited to put forward their views on the Late Night Trading Code of Practice.

It was first introduced in October 2013 following community concern about late-night, alcohol-fuelled violence in and around licensed venues. Reviews have prompted amendments introduced in February 2016 and November 2019. The Code applies to most licensed venues that trade past 2am.

Responses could be made using either the industry relevant survey or the community/patron relevant option. Alternatively, submissions were also accepted in writing via email.

More than 97 industry surveys and 359 community/patron perspective surveys were received along with 18 written submissions. Written submissions not marked ‘Confidential – Not for Publication’ enabling publication are available below.

The initial Draft Amendment Late Night Code was subject to further targeted consultation until 1 September 2023.

The Liquor and Gambling Commissioner considered feedback and determined the draft Late Night Code will be largely retained with minor changes to that announced on 8 August 2023. The role of drink marshals is only required every Saturday, Sunday or public holiday from 2.01am to 7am, rather than every day.

The amended Late Night Code will commence on 1 November 2023 with one month transition requiring compliance by 1 December 2023.
