The Gaming Machines Gambling Code of Practice prohibits a licensee from offering inducements directed at encouraging patrons to gamble.
Despite this, there are some inducements that are permitted in the form of:
- complimentary non-alcoholic beverages and refreshments of a nominal value
- participation in an acceptable trade promotion lottery
- participation in an acceptable loyalty program.
What is an acceptable loyalty program?
Under clause 25 of the Code, in order for a loyalty program to be deemed an acceptable loyalty program, it must be a structured program which:
- is conducted in accordance with published terms and conditions
- is advertised in a manner consistent with the advertising requirements of the licensees gambling products
- offers rewards proportionate to gambling activity (including non-monetary privileges attached to tiers in a stepped rewards system)
- offers regular activity statements
- has been approved by the Commissioner in terms of its rules and conditions, promotions, risk monitoring processes and the manner in which it is to be advertised and promoted.
A licensee will be in breach of the Code if they offer a gaming machine loyalty program to customers that has not been approved by the Commissioner.
Details of loyalty programs that have been approved as an acceptable loyalty program under clause 25 of the Code are provided below to assist licensees and members of the public.
